Terms & Conditions

Please read the following terms and conditions carefully before placing your pre-order. By purchasing a SkiDog pre-sale unit, you agree to the following:

 Payment

• Full payment is required to secure your SkiDog.
• The price of the SkiDog unit is exclusive of GST and delivery.

Cancellation & Refunds

• Change of Mind: We do not issue refunds for change of mind.
• Delay or Damage: SkiDog is not liable for damage incurred during delivery. Purchasers may add “Extra Cover” from Australia Post (https://auspost.com.au/sending/parcels-australia/optional-extras).
• We reserve the right to refund any order that is unreasonably delayed or is unable to be delivered.

Continuous Improvement

• We are always striving to make SkiDog better so we reserve the right to make changes to the design without prior notice.

Installation & Compatibility

• The purchaser is responsible for confirming the compatibility of their vessel’s existing dog clutch and crank hub prior to ordering a SkiDog unit. We take no responsibility for any damage caused or loss suffered as a result of installation of a SkiDog unit to an incompatible engine type.
• SkiDog Pty Ltd recommends that your SkiDog unit must be installed by a competent and appropriately qualified mechanic or marine mechanic, in accordance with the installation instructions provided. We take no responsibility for damage to the SkiDog unit or other property, or personal injury or death caused by or arising in any way from incorrect, improper or incomplete installation of the SkiDog unit.

Safety Warning

• Operating an inboard ski vessel with an installed SkiDog unit is a dangerous recreational activity. Your SkiDog unit must be installed and operated with care. Improper installation and/or operation of your SkiDog unit can result in injury or death.

Risk & Title

• All risk and liability for the SkiDog unit will transfer to you upon delivery to you or any third party who is acting on your behalf.
• Title to the SkiDog unit shall remain vested in SkiDog Pty Ltd and shall not pass to you until the purchase price has been paid in full and received in cleared funds by SkiDog Pty Ltd.

Privacy & Security

• When you place an order, we need to know your name, email, phone number, address and credit card details. This allows us to process and fulfil your order successfully. We will only use your personal information for the purposes for which you give it to us and will not disclose it to anyone else unless:
  • you have consented to its disclosure;
  • we have told you that we will or its disclosure is reasonably necessary to complete your pre-order purchase;
  • it is required or authorised by law; or
  • disclosure will prevent or lessen a serious or imminent threat to someone’s health or safety.
• When you place your order, you are doing so via a secure server that encrypts all information before it is sent to us. All credit card payments are processed securely through Stripe. We do not store any credit card information on our servers, however we can do so if you request it.

Warranty

• Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
• In addition to the warranties implied by the Australian Consumer Law, SkiDog comes with a 12-month manufacturer warranty against manufacturing and/or material defects (Warranty Period). The Warranty Period will commence on the date your SkiDog is ordered. Any defects identified and notified to SkiDog Pty Ltd in writing within the Warranty Period will be repaired or replaced at SkiDog Pty Ltd’s discretion.

Liability

• To the full extent permitted by Australian law, the liability of SkiDog Pty Ltd to the customer in respect of purchase and/or use of the SkiDog is limited, at SkiDog Pty Ltd’s discretion, to:
  • replacement of the SkiDog unit;
  • repair of the SkiDog unit;
  • payment of the cost of replacing the SkiDog unit; or
  • payment of the cost of having the SkiDog unit repaired.
• This limitation does not apply to limit SkiDog Pty Ltd’s liability to the customer arising out of or in connection with personal injury (including death) to any person, or any fraudulent, dishonest or malicious act or omission of SkiDog Pty Ltd or its personnel.
• To the full extent permitted by Australian law, and without limiting the liability of SkiDog Pty Ltd under the Australian Consumer Law, the customer acknowledges and agrees that SkiDog Pty Ltd has no liability to the customer (whether arising in contract, tort including negligence, statute, equity or otherwise) for Excluded Loss arising out of the purchase or use of the SkiDog. Excluded Loss means:
  • loss of revenue, use, production, goodwill, profit, income, business, contract or anticipated savings;
  • financing costs or increase in operating costs; or
  • other financial or economic loss or any other special, indirect, incidental, consequential, punitive or exemplary loss or damage.
• To the full extent permitted by Australian law, SkiDog Pty Ltd’s liability to a customer in respect of purchase and/or use of the SkiDog is reduced to the extent that an act or omission of the customer or its agent(s) caused or contributed to any claim, action, loss or damage arising in connection with the SkiDog, including but not limited to failure to comply with manufacturer installation and usage instructions.
• The customer agrees to indemnify SkiDog Pty Ltd against any claim, cost, expense, loss or damage (including any legal costs on a full indemnity basis) suffered or incurred by SkiDog Pty Ltd in relation to a claim, including by a third party, resulting from:
  • any intentional or negligent act or omission of the customer in installing or using the SkiDog, including but not limited to failure to comply with manufacturer installation and usage instructions;
  • any unauthorised modification of the SkiDog unit; and/or
  • any failure to comply with safety instructions or regulations.

Governing Law & Jurisdiction

• These terms and conditions will be governed by and construed according to the laws in force in the State of New South Wales and each party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts of New South Wales.
